What Is The Legal Process?

The requirements to file a petition for dissolution are the same as filing for divorce, except that it is between parties that are of the same sex.  If there are minor children involved, an Adoption may need to take place before the filing of a Petition for Dissolution of Marriage to establish parental rights of one of the parents.  The dissolution of marriage may need to be put on hold while the Adoption takes place.  If there is a disagreement on the parentage/paternity of the non-biological parent, that issue must be resolved prior to the dissolution or legal separation taking place so that neither parent waives rights that they are entitled to.

The parties can always attempt to reach a settlement by agreement, or can go through the process of exchanging discovery and having the court decide at trial once the issues related to the child(ren) have been dealt with.

In the interim, the court can still have hearings to settle issues temporarily and/or may conduct a pretrial conference to give recommendations to the parties on how to settle their case. The final decree is also called a judgment for dissolution or a judgment for legal separation.
